Terms and Conditions

The website www.privatetoursbarcelona.com and all its subdomains and or directories (referred to below as "the Site") is a property of Private Tours Barcelona and all content, information, and images provided on and through the Site may be used solely under the following Terms and Conditions.
The contracting any of the services offered on the Site (referred to below as "our Services") implies acceptance of each and every one of the Terms and Conditions.
By accessing or using the Site, the user (referred to below as "you") agrees to be legally bound by these terms and the following conditions. Private Tours Barcelona reserves the right to change these terms at any time and amendments will take effect when posted on the Site.

1. Booking Policy
The necessary steps to contract any of our Services are pointed out on the "How to book" page and are outlined in these Terms and Conditions. In case that there is any difference between the steps on "How to book" page and those below, latter will be applicable.
The steps to follow are:
  1. Selection of the desired service and providing all the information necessary to contract the service in question;
  2. Reading and agreeing to the present Terms and Conditions;
  3. Receival of the Reservation Confirmation at the provided e-mail address. This document does not bind you to the contracting any of our Services, nor does it oblige Private Tours Barcelona to provide you with the service in question;
  4. After checking availability, Private Tours Barcelona will send you the Booking Pre-confirmation, in which you are invited to either pay 30% of the total booking price through PayPal, or send by e-mail a copy at least one of the following documents:
    • booking confirmation of the flight of at least one of the participants;
    • booking confirmation of a cruise ship of at least one of the participants;
    • booking confirmation of a hotel of at least one of the participants.
  5. After confirmation of any of the above confirmation methods, you will receive the final Booking Confirmation. This document is the legal contract between you and Private Tours Barcelona and has to be presented at pick-up to our driver and or tour guide.
2. Prices
All prices mentioned on the Site are in Euros. Private Tours Barcelona reserves the right to changes these prices at any time and amendments will take effect when posted on the Site. Prices mentioned on the Site apply for non-contracted services. A service is non-contracted until receival of the final Booking Confirmation. If there is any difference between the prices mentioned on the Site at any given moment and those in the final Booking Confirmation, latter will be applicable.

3. Cancellation Policy
A cancellation of your reservation must be confirmed in writing. When your reservation is canceled, any payments you already made may not be fully refundable, depending on the time between receival of the cancellation and the planned date for the contracted service (referred to below as "tour date"). The percentages below are percentages of the total booking price. If the resulting non-refundable amount is higher than the amount paid, Private Tour Barcelona reserves the right to oblige you to pay the difference, by any then given payment method, with any then given term, as part of the Cancellation Policy.
If the cancellation is received at least 14 days before the tour date, a full refund will be given. When a cancellation is made between 13 and 7 days before the tour date, 20% will not be refundable. When a cancellation is made between 6 and 2 days before the tour date and time, 50% will not be refundable. When a cancellation is received after 48 hours before the tour date, the total booking price is non-refundable.
Private Tours Barcelona reserves the right to cancel your reservation. In case of cancellation by Private Tours Barcelona, any amounts paid will be fully refundable.

4. Last minute reservations
If a reservation is made between 72 and 48 hours before the tour date and time, an additional 20% of the total booking price may have to be paid. If a reservation is made within 48 hours before the tour date and time, an additional 50% fee of the total booking price may apply. Due to technical issues, this additional fee will not be stated at the site after reservation, nor in the Reservation Confirmation. If Private Tours Barcelona does however reserve the right to apply such a fee, and can decide to do so on the Booking Pre-confirmation. Whereas at this point there has not been contracted any service, you can decline if you wish.
If a reservation is made within 72 hours before the tour date and time, the only confirmation method is paying 30% of the total booking price through PayPal. In such a case, this will also be stated on the Booking Pre-confirmation. However, if Private Tours Barcelona decides so, all the above-mentioned confirmation methods may be allowed.

5. Availability and tour type
The prices per person per tour as mentioned on the Site are prices per seat of a total of 8 seats. If your group, including you, is smaller than or equal to 6 persons, Private Tours Barcelona reserves the right to occupy the remaining seats with other clients without notice.
Private Tours Barcelona tries to provide the contracted service on the day chosen by you. If this is in anyway impossible however, Private Tours Barcelona reserves the right to change the tour date to any date between your arrival and departure, as provided by you in the booking process. Private Tours Barcelona is obliged to inform you on such a change per e-mail, and you have the right to cancel your reservation if such information is received within 72 hours before the tour date and time. The applicable part of the cancellation policy in this case is that of a cancellation made between 13 and 7 days before the tour date.
In the booking process, you can select the option of a private tour. Prices mentioned on the Site upon selection this option apply. In this case, none of the remaining seats may be occupied by anyone else than you and your participants.

6. Security, theft, and damage
Private Tours Barcelona cannot be held responsible for any costs resulting from theft of, loss of, or damage to, goods, or personal damage occurring during the time that you use any of our Services. By contracting any of our Services, you assume the total responsibility of such costs, and that of contracting a travel insurance to cover, to a certain or any amount, these expenses.

7. Privacy Policy
USE OF INFORMATION
Private Tours Barcelona will only use information provided by you for the following purposes:
  • processing your reservation order;
  • sending you information about our services;
  • collecting any necessary payments as outline in the present Terms and Conditions.

SHARING INFORMATION
If you have given Private Tours Barcelona permission to do so during the booking process, we may send you information about our Services. If you wish, you can unsubscribe at any moment following the instructions as mentioned in the bottom part of any one of such e-mails. Other than as set out above, we will not disclose any of your personal information without your permission unless we are required by law to do so (e.g. if we are requiered to do so by a court order or for the purposes of prevention of fraud or other crimes).

8. Disclaimer
By using the Site you agree to comply with all applicable laws, statutes and regulations concerning your use of our Services and Private Tours Barcelona will not assume any responsibility thereof.

9. Applicable law
The applicable legislation shall be Law 34/2002, about services for computer companies and electronic commerce, Law 7/1998 about General Contracting Conditions, Royal Decree 1906/1999 through which telephone and electronic contracting is regulated with general development conditions in article 5.3 of Law 7/1998, General Law 26/1984 for Consumer and User Defence, Law 7/1996 about Retail Commerce Arrangements, Decree-Law 14/1999 regulator of Electronic Signatures, state laws about general contracting conditions (Law 7/1998 dated 13 April) and other legal regulations in force and applicable.
